1. Agreement
These Terms of Service govern your access to and use of Quiz Quest, an iOS mobile trivia game operated by Built by Foundry, Inc. (FKA Playpen Games, Inc.). By downloading, accessing, or using Quiz Quest, you agree to these Terms and the Privacy Policy.
If you do not agree, do not use Quiz Quest.
2. Eligibility
You must be at least 13 years old to use Quiz Quest. If you are under the age of majority where you live, you must use Quiz Quest with permission from a parent or legal guardian.
You must be at least 18 years old to make purchases, or you must have permission from a parent or legal guardian who agrees to these Terms.
3. Accounts
Quiz Quest may create an anonymous account automatically so your progress can be saved. You are responsible for activity on your account and for keeping your device secure.
Do not share accounts, sell accounts, transfer accounts, or use another person's account without permission.
4. Gameplay and Virtual Items
Quiz Quest includes virtual items and balances, including Gems, Energy, Gold, cosmetics, boosts, rewards, and similar items. These items are licensed for personal entertainment use inside Quiz Quest only.
- Virtual currency and virtual items have no cash value.
- Virtual currency and virtual items are not property and do not create an ownership interest.
- Virtual currency and virtual items are not transferable, redeemable, refundable, or exchangeable except where required by law or expressly allowed by us.
- Virtual currency and virtual items may be changed, limited, suspended, or removed as part of balancing, fraud prevention, legal compliance, or service changes.
- Unused virtual currency and virtual items may be forfeited if your account is terminated or deleted.
5. Purchases and Subscriptions
Purchases are processed by Apple through the App Store. Quiz Quest may offer consumables, nonconsumables, and subscription products. Prices and product details are shown in the App before purchase.
Subscriptions renew automatically through Apple unless canceled at least 24 hours before the end of the current period. You can manage or cancel subscriptions in Settings > Apple ID > Subscriptions.
Refunds are handled by Apple and are not provided by us except as required by Apple's refund policies or applicable law.
6. Code of Conduct
- Do not cheat, exploit bugs, automate gameplay, use bots, scrape data, interfere with matchmaking, or manipulate results.
- Do not harass, threaten, impersonate, defraud, or abuse other players.
- Do not reverse engineer, copy, modify, or interfere with Quiz Quest except where law gives you a nonwaivable right.
- Do not use Quiz Quest for unlawful activity or to infringe rights.
- Do not attempt to buy, sell, trade, or transfer accounts, virtual currency, rewards, or entitlements outside the App.
7. Ownership and License
Quiz Quest, including software, artwork, questions, characters, game systems, design, text, audio, trademarks, and other content, is owned by us or our licensors. We grant you a limited, revocable, personal, nonexclusive, nontransferable license to use Quiz Quest for personal entertainment according to these Terms.
Except for that license, we reserve all rights.
8. User Content and Feedback
If Quiz Quest lets you submit names, messages, feedback, or other content, you grant us a worldwide, royalty free license to host, store, reproduce, display, moderate, and use that content to operate and improve Quiz Quest.
You represent that you have the rights needed for anything you submit. We may remove content or restrict accounts at any time.
9. Termination
You may stop using Quiz Quest or request account deletion at any time. We may suspend, limit, or terminate access if we reasonably believe you violated these Terms, created risk, infringed rights, engaged in fraud, or used the App in a way that harms the service or other users.
Termination may result in loss of progress, virtual currency, virtual items, rewards, and entitlements except where law requires otherwise.
10. Disclaimers
Quiz Quest is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not guarantee that Quiz Quest will be uninterrupted, error free, secure, balanced, or available at all times.
11. Limitation of Liability
To the fullest extent permitted by law, we will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption.
To the fullest extent permitted by law, our total liability for all claims relating to Quiz Quest is limited to the greater of $100 or the amount you paid us through Quiz Quest in the 12 months before the event giving rise to the claim.
12. Disputes
These Terms are governed by Delaware law, without regard to conflict of law rules, except where your local consumer law gives you nonwaivable rights.
Any dispute will be resolved by binding individual arbitration administered by the American Arbitration Association under its applicable consumer rules, except that either party may bring an individual claim in small claims court. You and we waive jury trials and class actions to the fullest extent permitted by law.
This arbitration clause does not apply where prohibited by law.
13. Changes
We may update these Terms as Quiz Quest changes. If changes are material, we may provide notice in the App or by another reasonable method. Continued use after the effective date means you accept the updated Terms.
