1. Agreement
These Terms of Service govern your access to and use of Quiz Quest, an iOS mobile trivia game operated by Built by Foundry, Inc. ("BBF"). By accessing or using Quiz Quest, you agree to these Terms generally and acknowledge the Privacy Policy.
However, the Arbitration Agreement, class-action waiver, and jury-trial waiver apply only if you affirmatively accept them through an unchecked checkbox and acceptance control presented with links to these Terms and the Privacy Policy. Merely downloading, installing, accessing, or continuing to use Quiz Quest does not constitute acceptance of the Arbitration Agreement.
If you do not agree, do not use Quiz Quest.
2. Eligibility
You must be at least 13 years old to use Quiz Quest. If you are under the age of majority where you live, you must use Quiz Quest with permission from a parent or legal guardian.
You must be at least 18 years old to make purchases, or you must have permission from a parent or legal guardian who agrees to these Terms.
3. Accounts
Quiz Quest may create an anonymous account automatically so your progress can be saved. You are responsible for activity on your account and for keeping your device secure.
Do not share accounts, sell accounts, transfer accounts, or use another person's account without permission.
4. Gameplay and Virtual Items
Quiz Quest includes virtual items and balances, including Gems, Energy, Gold, cosmetics, boosts, rewards, and similar items. These items are licensed for personal entertainment use inside Quiz Quest only.
- Virtual currency and virtual items have no cash value.
- Virtual currency and virtual items are not property and do not create an ownership interest.
- Virtual currency and virtual items are not transferable, redeemable, refundable, or exchangeable except where required by law or expressly allowed by us.
- Virtual currency and virtual items may be changed, limited, suspended, or removed as part of balancing, fraud prevention, legal compliance, or service changes.
- Unused virtual currency and virtual items may be forfeited if your account is terminated or deleted.
5. Purchases and Subscriptions
Purchases are processed by Apple through the App Store. Quiz Quest may offer consumables, nonconsumables, and subscription products. Prices and product details are shown in the App before purchase.
For subscriptions, the price, trial length (if any), billing period, renewal terms, and cancellation details shown on Apple's purchase screen control. You can manage or cancel a subscription through your App Store account.
Refunds are handled by Apple under its rules, subject to rights that applicable law does not allow you to waive.
Apple App Store: Your license to Quiz Quest is governed by Apple's Standard Licensed Application End User License Agreement ("Apple Standard EULA") at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/. These Terms govern BBF accounts, subscriptions, server-side services, content, and conduct. They supplement the Apple Standard EULA but do not amend, replace, or supersede it. If these Terms conflict with the Apple Standard EULA concerning the App license, warranties, External Services, termination, damages exclusions, or limitation of liability, the Apple Standard EULA controls. Nothing in these Terms increases BBF's obligations or liability under the Apple Standard EULA.
6. Code of Conduct
- Do not cheat, exploit bugs, automate gameplay, use bots, scrape data, interfere with matchmaking, or manipulate results.
- Do not harass, threaten, impersonate, defraud, or abuse other players.
- Do not reverse engineer, copy, modify, or interfere with Quiz Quest except where law gives you a nonwaivable right.
- Do not use Quiz Quest for unlawful activity or to infringe rights.
- Do not attempt to buy, sell, trade, or transfer accounts, virtual currency, rewards, or entitlements outside the App.
7. Ownership and License
Quiz Quest, including software, artwork, questions, characters, game systems, design, text, audio, trademarks, and other content, is owned by BBF or its licensors.
The Apple Standard EULA supplies your license to Quiz Quest; these Terms do not grant a separate or broader App license. Except for that license, BBF reserves all rights.
8. User Content and Feedback
If Quiz Quest lets you submit names, messages, feedback, or other content, you grant us a worldwide, royalty free license to host, store, reproduce, display, moderate, and use that content to operate and improve Quiz Quest.
You represent that you have the rights needed for anything you submit. We may remove content or restrict accounts at any time.
9. Termination
You may stop using Quiz Quest or request account deletion at any time. We may suspend, limit, or terminate access if we reasonably believe you violated these Terms, created risk, infringed rights, engaged in fraud, or used the App in a way that harms the service or other users.
Termination may result in loss of progress, virtual currency, virtual items, rewards, and entitlements except where law requires otherwise.
10. Disclaimers
Quiz Quest is provided as is and as available. To the fullest extent permitted by law, we disclaim all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and noninfringement.
We do not guarantee that Quiz Quest will be uninterrupted, error free, secure, balanced, or available at all times.
11. Limitation of Liability
To the fullest extent permitted by law, BBF will not be liable for indirect, incidental, special, consequential, exemplary, or punitive damages, or for lost profits, lost data, loss of goodwill, or service interruption.
Apple-distributed App: To the fullest extent permitted by law, BBF's total aggregate liability to you for all claims arising out of or relating to Quiz Quest, its related services, these Terms, or the Apple Standard EULA, taken together under all legal theories, will not exceed the lesser of (a) $50 USD or (b) any lower aggregate limit provided by the Apple Standard EULA. This is one combined aggregate limit, not a separate limit under each agreement, claim, or theory. Nothing in these Terms increases or supplements the liability available under the Apple Standard EULA.
These exclusions do not apply to liability that cannot lawfully be limited. Your non-waivable consumer rights remain in effect.
12. Disputes
These Terms are governed by Delaware law, without regard to conflict of law rules, except where your local consumer law gives you nonwaivable rights.
Applicability and affirmative acceptance: This Arbitration Agreement applies only if you are an adult user in the United States and BBF's records demonstrate that you affirmatively accepted this version through the acceptance process described above. If BBF cannot produce that record, neither party is required to arbitrate under these Terms, and the class-action and jury-trial waivers in this section do not apply.
If the Arbitration Agreement applies, the Federal Arbitration Act governs it. Except for an eligible individual small-claims case or a claim for injunctive relief concerning misuse of intellectual property, disputes will be resolved by binding individual arbitration administered by the American Arbitration Association under its Consumer Arbitration Rules. You and BBF waive jury trials and class, collective, coordinated, and representative actions to the fullest extent permitted by law.
You may opt out by emailing support@builtbyfoundry.io within 30 days after the date you affirmatively accepted this Arbitration Agreement and stating your name, Quiz Quest, and that you opt out. The Arbitration Agreement does not apply to users outside the United States. If arbitration does not apply, you may bring an individual claim in a court available under applicable law and retain all non-waivable consumer protections.
13. Assignment and Corporate Transactions
BBF may assign or transfer these Terms and any rights or obligations under them, in whole or in part, without your consent, to an affiliate or successor in connection with a merger, acquisition, financing, reorganization, change of control, sale of the App or relevant business line, sale of all or substantially all relevant assets, or operation of law. Any assignee will take these Terms subject to the obligations applicable to it, and BBF will provide any notice required by law. You may not assign or transfer these Terms without BBF's prior written consent. Any attempted transfer contrary to this section is void. Any transfer of personal information remains subject to the Privacy Policy and applicable law.
14. Changes
BBF may update these Terms as Quiz Quest or applicable law changes. If changes are material, BBF may provide notice in the App or by another reasonable method. Changes apply prospectively. A revised Arbitration Agreement applies only if you affirmatively accept that version through the acceptance process described above.
