Acceptable Use Policy

All defined terms used in this Acceptable Use Policy ("AUP") have the meanings set forth in the Foundry Terms of Service ("Terms") unless otherwise defined herein.At Foundry, our mission is to help creators build and scale digital businesses powered by AI. Our Platform is used by creators across diverse industries, audiences, and content types. We want every creator to feel empowered to grow their brand, and we take our role in keeping abuse off the Platform seriously. This AUP outlines what is and is not allowed on Foundry.All Creators must follow this AUP in their use of the Platform and any related services. If you violate this AUP, we may suspend or terminate your Account, take your App offline, remove content, and report violations to impacted third parties, application store operators, or law enforcement authorities where appropriate.

Legal Compliance

You must use the Platform in compliance with all applicable laws, regulations, and third-party rights. This includes (without limitation) laws governing intellectual property, privacy, data protection, consumer protection, advertising disclosures, and electronic communications. We encourage you to seek independent legal counsel to determine what laws apply to your business and your use of the Platform.

Your Responsibilities

You are responsible for the content and brand materials you provide to Foundry, for the nature and purpose of the App built on your behalf, and for your conduct while using the Platform. You must comply with the following requirements:• You may not use the Platform to facilitate any unlawful activity, or for any purpose where use of the Platform could lead to physical harm, death, or personal injury.
• You may not provide content or direct Foundry to build an App that targets or collects personal information from individuals under the age of 16 (or under any other age restriction applicable in your jurisdiction) without appropriate parental consent mechanisms.
• You may not access or use the Platform for the purpose of building a product or service that competes with Foundry, or for any other competitive intelligence purposes.
• You may not misuse the Platform by interfering with its normal operation or attempting to access it through methods other than the interfaces and instructions we provide.
• You may not probe, scan, or test the vulnerability or security of the Platform or any Foundry system or network without our prior written authorization.
• You may not use any manual or automated system to extract, scrape, or harvest data from the Platform without our prior written authorization.
• You may not reverse-engineer, decompile, disassemble, or otherwise attempt to derive the source code, algorithms, AI models, or underlying technology of the Platform.
• You may not store or transmit viruses, malware, or other malicious software through the Platform, or provide content or instructions intended to produce such output.
• You may not use the Platform to infringe the intellectual property rights of others.
• You may not resell, lease, or sublicense the Platform or access to the Services without our prior written consent.
• You may not engage in abusive or excessive usage of the Platform that adversely affects the speed, responsiveness, stability, or functionality of the Services for other users.

AI Systems and Prompt Safety

The Platform uses artificial-intelligence and machine-learning systems to build, optimize, and operate Apps. You must use these systems responsibly. The following activities are prohibited:• Prompt injection, jailbreaking, or any attempt to manipulate, override, bypass, or circumvent the safety mechanisms, instructions, guardrails, or intended behavior of Foundry's AI systems.
• Submitting content, instructions, or inputs designed to cause the AI systems to generate output that violates this AUP, applicable law, or application store policies.
• Attempting to extract, replicate, or reverse-engineer the training data, model weights, system prompts, or proprietary logic of Foundry's AI systems.
• Using the Platform to generate content that impersonates real individuals without their consent, or that creates deepfakes, synthetic media, or other deceptive AI-generated content intended to mislead.
• Using the Platform to generate spam, phishing content, or automated communications designed to deceive End Users or third parties.

Application Store Compliance

Apps built through the Platform are published to Apple's App Store, Google Play, and other application marketplaces. You are responsible for ensuring that the content, purpose, and functionality of your App comply with the guidelines and policies of the applicable application store operators, including (without limitation) Apple's App Store Review Guidelines and Google Play's Developer Program Policies.You may not direct Foundry to build, publish, or maintain an App that:• Violates any application store policy or guideline.
• Is designed to deceive or mislead End Users about its purpose or functionality.
• Contains hidden or undisclosed features, functionality, or data collection.
• Engages in fraudulent billing, subscription manipulation, or deceptive monetization practices.
• Manipulates App Store ratings, reviews, or search rankings through artificial or deceptive means.
If an App is rejected or removed by an application store operator due to content or functionality that you directed or provided, you remain responsible for all applicable Platform Fees and Foundry will not be liable for any resulting loss of revenue or access.

Prohibited Content

You may not provide content to Foundry, or direct Foundry to create Apps, that contain or promote:Violence and Threats. Content that directly or indirectly threatens or attacks others, organizes or incites violence, promotes terrorism, or glorifies self-harm.Hate Speech. Content that attacks, demeans, or advocates for the exclusion of people based on race, ethnicity, national origin, religion, gender, age, sexual orientation, disability, or any other protected characteristic under applicable law.Child Exploitation. Any content that exploits or endangers children, including images or depictions of child abuse, content that presents children in a sexual manner, or solicitation of personally identifiable information from children.Pornography and Explicit Material. Gratuitous graphic violence, unlawful pornography, or material that is otherwise indecent. Nudity or adult content that may have a legitimate purpose must include conspicuous content warnings.Misinformation. False, inaccurate, or intentionally deceptive information that is likely to cause harm to the public or adversely affect public health, safety, election integrity, or civic participation.Harassment and Bullying. Content used to bully, harass, defame, stalk, or threaten any individual.Intellectual Property Infringement. Content that infringes copyrights, trademarks, or other intellectual property rights of third parties. You must have appropriate rights to all content you provide to Foundry.

Malicious and Deceptive Practices

You may not use the Platform for fraudulent, deceptive, or malicious purposes, including (without limitation):• Collecting sensitive personal information (such as social security numbers, credit card numbers, or passwords) outside of authorized payment flows.
• Publishing another person's sensitive identifying information without their consent.
• Promoting pyramid schemes, multi-level marketing scams, or other fraudulent earning opportunities.
• Impersonating another person or entity, or misrepresenting your affiliation with any person or entity.
• Using the Platform to distribute malware, phishing attacks, or links to malicious websites.
• Knowingly inflating or manipulating App metrics, download counts, or engagement data through artificial means.

Privacy and Data Protection

You are responsible for complying with all applicable data protection laws and regulations with respect to any data you submit to or collect through the Platform. You must act in accordance with the privacy practices disclosed to your End Users. You may not claim that any use of the Platform is anonymous when it is not, and you may not collect or process End User data in ways that exceed the scope of the disclosures in your App's privacy policy.

Foundry's Rights

Foundry is not responsible for and does not necessarily endorse the content, Apps, or businesses of our Creators. You acknowledge that by providing you with the ability to have an App built and operated through the Platform, Foundry is not undertaking any obligation or liability relating to your content.Foundry may review content submitted to the Platform to determine whether it is illegal or violates this AUP or the Terms. We have the sole discretion to modify, prevent access to, remove, or refuse to publish any content or App that we believe violates law, this AUP, the Terms, or application store policies. If Foundry determines that any use of the Platform violates this AUP, causes damage to our brand or reputation, or results in complaints from application store operators or third parties, we have the right to suspend or terminate your Account and take your App offline.Foundry may modify this AUP at any time by posting a revised version at builtbyfoundry.io/policies/aup. By continuing to use the Platform after a revised version has been posted, you agree to comply with the latest version.

Reporting Violations

If you identify content or an App that you believe violates this AUP, you may report it to abuse@builtbyfoundry.io. Please include as much detail as possible, including the App name and a description of the violation.

Enforcement

Depending on the nature and severity of the violation, Foundry may respond in any of the following ways:Warning and Cure Period. For less severe or first-time violations, we may notify you and give you an opportunity to cure the violation within a reasonable period.Suspension. We may suspend your access to the Platform or specific services. Your App may be taken offline until the issue is resolved and has passed a policy review.Termination. For serious or repeated violations, we may immediately terminate your Account and take your App offline permanently. We may report illegal activity to law enforcement authorities as required or permitted by law.If you believe your Account has been suspended or terminated in error, you may request a review by emailing abuse@builtbyfoundry.io.
