1. Agreement to Terms
These Terms of Service govern your use of the Taiyaar mobile application ("App") operated by Built by Foundry, Inc., formerly known as Playpen Games, Inc. ("Foundry"). By using the App, you agree to these Terms and our Privacy Policy. If you don't agree, please uninstall the App.Age Requirement: You must be at least 13 years old to use Taiyaar. If you're 13-17, review these Terms with a parent or guardian.2. About Taiyaar
Taiyaar is an iOS application that helps the South Asian diaspora swipe through Indian outfit looks curated by Tavi Gandhi (@tavigandhi), save favorites to event-specific boards with custom labels, and tap through to third-party retailers who ship internationally. Taiyaar V1 has no user accounts, no sign-in, and no in-app purchases.Not a Retailer or Marketplace: Taiyaar curates and links to looks sold by third-party South Asian fashion retailers. Foundry is not the seller of any item shown in the App. We do not process your order, accept your payment, ship your garment, handle returns or exchanges, or provide retailer customer service. Sizing charts, fabric specifics, color accuracy, lead times, customs and duties, return windows, and refund policies are determined by the retailer. Always read the retailer's product page and terms before ordering. Foundry is not responsible for retailer errors, delays, damages, or disputes; those are between you and the retailer.
Catalog and Vendor Image Rights: Catalog imagery and product copy shown in the swipe feed are licensed from the underlying retailers and remain their property. You receive a personal, non-commercial license to view that imagery inside the App only. Do not screenshot at scale, screen-record, scrape, mirror, redistribute, or rehost catalog imagery, vendor data, or any other content shown in the App for any purpose other than personal browsing.
3. Account Registration
Some features require an account via Sign in with Apple or Google. You agree to provide accurate information, keep credentials secure, and notify us of unauthorized access. You're responsible for all account activity.4. Premium Subscriptions and Billing
No paid plans in V1: Taiyaar V1 is free to download and use. There are no in-app purchases, no subscriptions, no auto-renewing tiers, and no paid feature gates in this version.Future changes: We may introduce paid features in a future release. If we do, we will update these Terms before any charge is made and will follow Apple App Store rules for in-app purchases, free trials, auto-renewal disclosure, cancellation, and refunds. Any future paid plan would be processed by the Apple App Store, and refund requests would be handled by Apple at https://reportaproblem.apple.com/. Foundry would not be able to issue store-purchase refunds directly.5. User Content
Foundry's data ownership: as you use Taiyaar, the App captures your swipe activity, your saved looks, the boards and labels you create, and the preferences you set. By using the App, you grant Foundry a perpetual, irrevocable, worldwide, royalty-free, sublicensable license to host, store, copy, transmit, process, analyze, aggregate, de-identify, create derivative works of, and otherwise use that activity and that data for any lawful business purpose, including operating and improving Taiyaar, informing Tavi's curation, training internal models for ranking and recommendation, building new products and features, and creating aggregated, de-identified insights about South Asian fashion demand. Foundry does not sell identifiable personal information.Your board labels and free-text input: you keep ownership of any free-text labels you write (for example a board name like "Aanya's mehndi"). The license you grant Foundry above includes the right to host, store, and process those labels as needed to operate the App for you. You will not include in a label any content that violates the Acceptable Use rules below.Vendor catalog: Look imagery and product information shown in the swipe feed are licensed from the underlying retailers and remain their property. You receive a personal, non-commercial license to view that content inside the App only.Tavi's content: Tavi Gandhi's name, the @tavigandhi handle, her likeness, her brand marks, her curation choices (which looks appear in the catalog and how they are sequenced), her curator notes (including the in-app "why it works" copy and any styling commentary attributed to her), and any other content authored or directed by Tavi inside the App are her property and are licensed to you for personal, non-commercial use within the App only. You may not (a) extract, scrape, download in bulk, redistribute, repackage, resell, or rehost Tavi's curated catalog or curator notes, (b) train, fine-tune, or evaluate any model on Tavi's curation or curator notes, (c) imitate Tavi's voice or persona to imply her endorsement of any product or service other than Taiyaar, or (d) use Tavi's name, handle, or likeness in advertising, sponsorship, or promotional materials without her prior written permission.Content standards: You will not submit content (including board labels) that (a) infringes a third party's intellectual property, publicity, or privacy rights, (b) is unlawful, hateful, harassing, defamatory, or sexually explicit, (c) contains malware, exploits, or material designed to circumvent the App, or (d) contains another person's private information. We may remove content that violates these standards.Deletion: To delete the data tied to your installation, email privacy@builtbyfoundry.io with the device-installation identifier shown at the bottom of the Profile screen. We will remove or de-identify your matching records within 30 days (backups purged within 90 days). Aggregated and de-identified data that no longer reasonably identifies you may be retained.6. Acceptable Use
You will use Taiyaar only for lawful, personal, non-commercial purposes. You will not (a) reverse engineer, decompile, disassemble, or attempt to derive the source code of the App except to the extent that this restriction is prohibited by law, (b) use any robot, spider, scraper, or other automated means to access the App, the catalog, the curator notes, or any other content, (c) interfere with, disrupt, probe, or test the security of the App or its supporting infrastructure, (d) use the App, its catalog, its curator notes, or any data drawn from it to build a competing product, dataset, or model, (e) submit content on behalf of someone else without authorization, (f) use the App in any country or to any person where doing so is prohibited by U.S. or other applicable export, sanctions, or trade laws, or (g) use the App in any other manner that violates these Terms or applicable law. We reserve the right to suspend or terminate access for any violation.7. End User License Agreement
This section is Taiyaar's End User License Agreement (EULA) and supplements these Terms. By installing or using Taiyaar on an Apple device, you also agree to the Apple Licensed Application End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/, except as the terms below modify it.License: Subject to your compliance with these Terms, Foundry grants you a limited, non-exclusive, non-transferable, revocable license to install and use Taiyaar on a device that you own or control, solely for your personal, non-commercial use as a shopper.Restrictions: You will not (a) copy, modify, or create derivative works of the App except as permitted by law, (b) reverse engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by law, (c) rent, lease, lend, sell, sublicense, or otherwise transfer the App, (d) remove or alter any proprietary notices, (e) use the App or its data to build a competing product, (f) scrape, mirror, or redistribute the catalog imagery, vendor data, curator notes, or any other content shown in the App, or (g) use the App in violation of applicable law.Reservation: Foundry, Tavi Gandhi, the participating retailers, and our licensors retain all right, title, and interest in and to the App and its content, including all intellectual property rights. No rights are granted except as expressly stated.Termination: This license terminates automatically if you materially breach these Terms. On termination, you must stop using and delete the App. Sections that by their nature should survive (including intellectual property, the Foundry data-ownership license, disclaimers, warranty disclaimers, limitation of liability, indemnity, and dispute resolution) will survive termination.Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms with respect to your license to use Taiyaar on Apple devices and may enforce these Terms against you. Tavi Gandhi is also an intended third-party beneficiary of these Terms with respect to the protections given to her name, handle, likeness, curation, and curator notes, and may enforce those protections against you.Export and sanctions: You represent that you are not located in a country subject to a U.S. Government embargo or designated by the U.S. Government as a 'terrorist supporting' country, and that you are not on any U.S. Government list of restricted parties.8. Third-Party Retailers
When you tap a vendor link inside Taiyaar, you leave the App and enter a third-party retailer's website. Your interactions with that retailer (including account creation, ordering, payment, shipping, customs, duties, returns, and customer service) are governed entirely by that retailer's terms and privacy policy, not Foundry's. Foundry has no control over retailer pricing, inventory, lead times, fulfillment, or product quality. We surface vendors that ship to the country you selected during onboarding, but we cannot guarantee any specific shipping outcome. Any claim, complaint, or dispute about an item or an order is between you and the retailer.9. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE APP AND THE CATALOG ARE PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTY OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, OR THAT THE APP WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE. FOUNDRY, TAVI GANDHI, AND OUR LICENSORS DO NOT WARRANT THAT ANY OUTFIT SHOWN IN THE APP IS IN STOCK, AVAILABLE FOR SHIPMENT TO YOUR ADDRESS, ACCURATELY DESCRIBED, OR FREE OF DEFECTS. NO ADVICE OR INFORMATION OBTAINED THROUGH THE APP CREATES ANY WARRANTY NOT EXPRESSLY MADE IN THESE TERMS.10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, FOUNDRY, TAVI GANDHI, AND OUR OFFICERS, DIRECTORS, EMPLOYEES, CONTRACTORS, AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR RELATED TO YOUR USE OF THE APP, ANY ITEM YOU ORDER FROM A THIRD-PARTY RETAILER, OR ANY UNAUTHORIZED ACCESS TO YOUR DATA, EVEN IF FOUNDRY HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT WILL THE AGGREGATE LIABILITY OF FOUNDRY AND TAVI GANDHI ARISING OUT OF OR RELATED TO THESE TERMS OR THE APP EXCEED ONE HUNDRED U.S. DOLLARS (US$100). SOME JURISDICTIONS DO NOT ALLOW EXCLUSIONS OR LIMITATIONS OF CERTAIN DAMAGES, SO PARTS OF THIS SECTION MAY NOT APPLY TO YOU.11. Indemnification
You will defend, indemnify, and hold harmless Foundry, Tavi Gandhi, and our affiliates, officers, directors, employees, contractors, and agents from and against any claims, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees) arising out of or related to (a) your violation of these Terms, (b) your misuse of the App, (c) your violation of any applicable law or third-party right (including any retailer's terms), or (d) any content you submit to the App.12. Governing Law and Dispute Resolution
These Terms are governed by the laws of the State of Delaware, USA, without regard to conflict of laws principles. Any dispute arising out of or related to these Terms or the App will be resolved exclusively in the state or federal courts located in Delaware, and you and Foundry consent to personal jurisdiction and venue in those courts. Nothing in this section prevents Foundry from seeking injunctive or equitable relief in any court of competent jurisdiction to protect its or Tavi Gandhi's intellectual property or confidential information. The U.N. Convention on Contracts for the International Sale of Goods does not apply.13. Changes to These Terms
We may update these Terms from time to time. If we make a material change, we will update the "Last Updated" date at the top of these Terms and, where required by law or where the change is significant, take additional steps to notify you (for example, an in-app notice). Continued use of the App after the change becomes effective means you accept the updated Terms.14. Prohibited Conduct
Don't: reverse engineer the App, attempt unauthorized access, use bots or scrapers, share account credentials, distribute abusive content, violate laws, interfere with the App's operation, or commercially exploit App content.We may suspend or terminate accounts that violate these Terms.15. Intellectual Property
All trademarks, logos, audio recordings, content, and App materials are owned by Foundry or licensors. You receive a limited, personal, non-commercial license to use the App. Don't copy, reproduce, or commercially exploit App content.16. Limitation of Liability
The App is provided "as is" without warranties. To the fullest extent permitted by law:• We're NOT liable for indirect, incidental, or consequential damages (including lost data)• Our total liability is capped at the greater of what you paid us in the last 12 months or $100 USDExceptions: This doesn't limit liability for death/injury from gross negligence, fraud, or liability we can't exclude by law. EU/UK/California consumer rights are not affected.If you experience harm related to App content, report it to hello@builtbyfoundry.io. We'll investigate and take appropriate action.
