1. Agreement to These Terms

These Terms of Service govern your use of the Stain Savior mobile application and related services operated by Built by Foundry, a division of Playpen Games, Inc., for Southern Escape ("App"). By downloading, accessing, or using the App, you agree to these Terms and the Stain Savior Privacy Policy. If you do not agree, do not use the App.You must be at least 13 years old to use the App. If you are under the age of majority where you live, you must use the App with permission from a parent or legal guardian.

2. What Stain Savior Does

Stain Savior helps users capture or upload a stain photo, identify likely stain and surface types, and receive practical cleaning steps, timers, substitutions, and escalation guidance.The App is designed to provide general cleaning guidance only. It is not a substitute for professional restoration, dry-cleaning, upholstery, leather, environmental, or hazardous-material advice.

3. Accounts and Access

Some features may be available without an account, while others may require you to create an account or sign in with email, Apple, Google, or other supported identity providers. You are responsible for maintaining the confidentiality of your credentials and for activity that occurs through your account.You agree to provide accurate information and to notify us promptly if you believe your account has been compromised.

4. Subscriptions, Billing, and Trials

Certain features may require a paid subscription. Pricing, billing intervals, and any trial terms will be shown to you at checkout.Unless stated otherwise at purchase, subscriptions renew automatically until canceled. You authorize the applicable billing platform to charge your selected payment method for renewals, taxes, and other applicable fees.You can manage or cancel your subscription through the App Store, Google Play, or any customer center or billing flow made available to you. Refunds are handled by the billing platform you used to purchase, except where applicable law requires otherwise.We may change pricing or plans in the future. If required, we will provide notice before the change takes effect.

5. Your Content

You retain ownership of the photos, corrections, and other content you submit to the App. You grant us a limited license to host, store, reproduce, analyze, and display that content as needed to operate, secure, and improve the App.You must not upload content you do not have the right to share, or content that contains unlawful material, another person's highly sensitive personal information, malware, or infringing content.

6. Acceptable Use

You agree not to:• Reverse engineer, decompile, scrape, or interfere with the App or its services
• Use the App in violation of law or another person's rights
• Upload misleading, abusive, infringing, or dangerous content
• Use automated means to access the App except through approved interfaces
• Attempt to bypass subscription controls, security measures, or usage limitsWe may suspend or terminate access if we believe these Terms have been violated.

7. Safety and AI Disclaimer

Stain Savior uses automated systems, including AI-assisted classification, to generate stain diagnoses and cleaning steps. Those outputs may be incorrect, incomplete, or not appropriate for your specific fabric, surface, product, or environment.You are responsible for how you act on App guidance. Always read product labels, test any treatment on an inconspicuous area first where appropriate, and use reasonable safety precautions such as gloves, ventilation, and avoiding incompatible chemicals.Do not rely on the App for hazardous spills, biohazards, mold remediation, medical emergencies, chemical burns, or situations requiring licensed or emergency services. Seek qualified professional help when appropriate.

8. Intellectual Property

The App, including its software, branding, designs, text, graphics, and service outputs other than your submitted content, is owned by Foundry, Southern Escape, or their licensors and is protected by intellectual property laws.Subject to these Terms, we grant you a limited, revocable, non-exclusive, non-transferable license to use the App for personal, non-commercial purposes.

9. Termination

You may stop using the App at any time. We may suspend or terminate your access if you breach these Terms, create risk for other users or us, or if we discontinue the App.Sections that by their nature should survive termination, including ownership, disclaimers, liability limitations, dispute terms, and payment obligations, will survive.

10. Disclaimer of Warranties

The App is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement, to the fullest extent permitted by law.We do not guarantee that the App will be uninterrupted, secure, accurate, or error-free, or that following any recommendation will remove a stain or prevent damage.

11. Limitation of Liability

To the fullest extent permitted by law, Foundry, Playpen Games, Inc., Southern Escape, and their affiliates, officers, employees, contractors, and licensors will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any loss of profits, revenues, goodwill, data, or property damage, arising out of or related to your use of the App.Our total liability for any claim relating to the App will not exceed the greater of the amount you paid us for the App in the 12 months before the claim arose or $100 USD. Some jurisdictions do not allow certain limitations, so some of the above may not apply to you.

12. Governing Law and Disputes

These Terms are governed by the laws of the State of Delaware, without regard to its conflict-of-law rules, except where mandatory consumer protection laws in your jurisdiction require otherwise.Before filing a formal claim, contact hello@builtbyfoundry.io so we can try to resolve the dispute informally.If a dispute cannot be resolved informally, it will be brought exclusively in the state or federal courts located in Delaware, unless applicable law gives you the right to bring the claim elsewhere.

13. Changes to These Terms

We may update these Terms from time to time. If we make material changes, we may provide notice in-app, by email, or by updating the effective date above. Your continued use of the App after revised Terms take effect means you accept them.
