1. Agreement to these Terms
These Terms of Service govern your use of the Stain Fix mobile app for iOS and Android, operated by Playpen Games, Inc., a Delaware C corporation doing business as Software People Love and Built by Foundry ("Playpen Games," "we," "us"). By creating an account or using Stain Fix, you agree to these Terms and to the Stain Fix Privacy Policy.Stain Fix is intended for users aged 18 and over. If you do not agree to these Terms, please do not use the app.2. Your account
You can create an account using your email, Sign in with Apple, or Sign in with Google. You are responsible for keeping your login secure and for everything that happens under your account.You can delete your account at any time from inside the app, or by following the steps on our data deletion page. We may suspend or close accounts that violate these Terms.3. Acceptable use
When you use Stain Fix, you agree not to:• Break the law or use the app to harm anyone• Upload content you do not have the right to share, including photos of other people's property without permission
• Upload content that is unlawful, abusive, or infringes on someone else's rights
• Attempt to reverse engineer, scrape, or interfere with the app or its servers
• Share your account credentials or try to bypass subscription or security controls
4. Subscriptions and billing
Some Stain Fix features require a paid subscription. Pricing and any free trial terms are shown inside the app before you subscribe.Billing is handled by the Apple App Store or the Google Play Store, depending on where you downloaded the app. Subscriptions renew automatically until you cancel. You authorize Apple or Google to charge your selected payment method for renewals and applicable taxes.To cancel, open your subscriptions in the App Store or Google Play Store and cancel Stain Fix there. Your access continues until the end of the current billing period. Refunds are handled by Apple or Google according to their policies, except where applicable law requires otherwise.If we change pricing for future billing periods, we will give you notice before the change takes effect.5. AI stain diagnosis disclaimer
Stain Fix provides suggestions based on AI analysis of user submitted photos. Always test treatments on a hidden spot first. Follow manufacturer care labels. We are not liable for damage to garments or fabrics.AI generated guidance can be wrong or incomplete. It is not a substitute for professional dry cleaning, upholstery, leather, or restoration services. Do not rely on Stain Fix for hazardous spills, biohazards, mold, chemical burns, or any situation that requires emergency or licensed professional help.6. Your photos and content
You keep all rights to the photos and other content you submit to Stain Fix. By uploading, you grant Playpen Games a limited, worldwide, royalty free license to store, process, analyze, and display that content for the purpose of running the app for you, including sending it to the AI providers described in our Privacy Policy.We do not use your stain photos to train public AI models, and we do not share them with anyone other than the service providers needed to run the app.7. Our intellectual property
The Stain Fix app, including its software, design, name, logo, and all content we create, is owned by Playpen Games or its licensors (including Kristen Donathan for her methodology and contributed content) and is protected by copyright, trademark, and other laws. Subject to these Terms, we grant you a limited, revocable, non exclusive, non transferable license to use Stain Fix for personal, non commercial use.8. Warranties and liability
Stain Fix is provided on an "as is" and "as available" basis without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non infringement, to the fullest extent permitted by law.To the fullest extent permitted by law, Playpen Games and its officers, employees, contractors, and partners will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, lost data, or damage to garments, fabrics, or other property, arising out of or related to your use of the app. Our total liability for any claim related to Stain Fix will not exceed the greater of the amount you paid us in the 12 months before the claim arose or one hundred US dollars ($100).Some jurisdictions do not allow certain limitations, so some of the above may not apply to you. Nothing in these Terms limits any rights you have under mandatory consumer protection law.9. Termination
You may stop using Stain Fix at any time by deleting your account. We may suspend or terminate your access if you break these Terms, create risk for other users or for us, or if we discontinue the app. Sections that should survive termination (including ownership, disclaimers, liability limits, and governing law) will continue to apply.10. Governing law
These Terms are governed by the laws of the State of Delaware, without regard to its conflict of laws rules, except where mandatory consumer protection laws where you live require otherwise. Before filing a formal claim, contact westonbdev@gmail.com so we can try to resolve the dispute informally.11. Changes to these Terms
We may update these Terms from time to time. If we make a material change, we will update the effective date above and let you know inside the app before the change takes effect. Continued use of Stain Fix after that point means you accept the updated Terms.12. Contact
