1. Agreement to Terms

These Terms of Service govern your use of the Is This BS mobile application ("App") operated by Built by Foundry, a division of Playpen Games, Inc. By using the App, you agree to these Terms and our Privacy Policy. If you don't agree, please uninstall the App.Age Requirement: You must be at least 13 years old to use Is This BS. If you're 13-17, review these Terms with a parent or guardian.

2. About Is This BS

Is This BS is an AI-powered critical thinking tool created in collaboration with Professor Dave Explains. The App lets you submit claims for AI analysis, participate in daily challenges, track your progress with streaks and XP, and explore a library of common logical fallacies.AI Analysis: Claims you submit are analyzed by artificial intelligence (OpenAI) to evaluate their accuracy and identify logical fallacies. AI-generated analysis is for educational purposes only, may contain errors, and is not a substitute for peer-reviewed research or professional fact-checking. All AI-generated content is owned by Foundry; you receive a personal license to use it within the App.Claim Caching: To improve performance, identical claims return cached results. Your claim text is hashed and stored so that repeated analyses of the same claim can be served faster.

3. Account Registration

Some features require an account via Sign in with Apple. You agree to provide accurate information, keep credentials secure, and notify us of unauthorized access. You're responsible for all account activity. Account creation is optional; limited features are available without signing in.

4. Premium Subscriptions and Billing

Free Tier: All users receive one claim analysis per day plus access to the daily challenge.Premium Features: Premium subscribers get unlimited claim analyses, shareable analysis cards, access to the full fallacy library, and other premium features. Pricing is shown in the App.Free Trials: New subscribers may receive a free trial. Trials convert to paid subscriptions automatically unless you cancel at least 24 hours before the trial ends.Auto-Renewal: Subscriptions renew automatically at the end of each billing period unless canceled. You'll be charged the current subscription price.Cancellation: Cancel anytime via iPhone Settings → [Your Name] → Subscriptions → Is This BS → Cancel, or in the App: Settings → Manage Subscription → Cancel. Cancellation takes effect at the end of the current period.Refunds: Generally non-refundable except: (a) as required by law (EU: 14-day withdrawal right), (b) technical issues preventing access (contact support within 7 days), (c) unauthorized charges.Price Changes: We may change prices with 30 days' notice.

5. User Content

Your Claims: You retain ownership of the claim text you submit. By using the App, you grant us a limited license to store, cache, process via AI, and display your claims and their analysis results within the App and across your devices.What We Won't Do: Sell your claim data to third parties, use individual claims in marketing without consent, or share your claims with other users.Content Standards: Don't submit illegal, harassing, defamatory, or infringing content.Deletion: If you delete your account, we'll delete your personal data within 30 days (backups purged within 90 days). Anonymized cached claim analyses may be retained.

6. AI and Educational Disclaimer

Important: Is This BS is an educational and entertainment tool designed to promote critical thinking. AI-generated claim analyses are NOT professional fact-checking, scientific advice, journalism, legal counsel, or medical guidance.AI Limitations: AI analysis may contain errors, miss nuance, or produce inaccurate results. We don't guarantee the accuracy of any analysis. Always verify important claims through peer-reviewed research, authoritative sources, and qualified professionals.Not a Substitute: Is This BS is not a substitute for academic research, professional journalism, legal advice, medical consultation, or expert opinion. Use analysis results as a starting point for your own critical thinking, not as a definitive verdict.Your Responsibility: You are responsible for how you use and share analysis results. Results vary and aren't guaranteed. Decisions made based on AI analysis are your own.

7. Prohibited Conduct

Don't: reverse engineer the App, attempt unauthorized access, use bots or scrapers, share account credentials, submit abusive or harmful content, violate laws, interfere with the App's operation, or commercially exploit AI-generated analyses.We may suspend or terminate accounts that violate these Terms.

8. Intellectual Property

All trademarks, logos, educational content, AI-generated analyses, fallacy descriptions, and App materials are owned by Foundry or licensors. "Professor Dave Explains" branding is used under license. You receive a limited, personal, non-commercial license to use the App. Don't copy, reproduce, or commercially exploit App content.

9. Limitation of Liability

The App is provided "as is" without warranties. To the fullest extent permitted by law:• We're NOT liable for indirect, incidental, or consequential damages (including lost data or decisions made based on AI analysis)
• Our total liability is capped at the greater of what you paid us in the last 12 months or $100 USDExceptions: This doesn't limit liability for death/injury from gross negligence, fraud, or liability we can't exclude by law. EU/UK/California consumer rights are not affected.If you experience harm related to App content, report it to hello@builtbyfoundry.io. We'll investigate and take appropriate action.

10. Dispute Resolution

Try to Resolve First: Contact hello@builtbyfoundry.io before filing legal claims.

US Residents

Arbitration: Disputes resolved through binding individual arbitration (AAA Consumer Arbitration Rules), except small claims court. Location: Delaware or your county (your choice). We pay AAA fees for claims under $10,000. No class actions.Opt-Out: Email hello@builtbyfoundry.io within 30 days of first use with "Arbitration Opt-Out" in the subject line.

California Residents

California law applies. You may choose JAMS instead of AAA. If class waiver is unenforceable, arbitration clause is void.

EU/UK Residents

No Forced Arbitration: This arbitration clause does NOT apply. You retain rights under EU consumer laws, including bringing disputes in your local courts. EU Online Dispute Resolution: ec.europa.eu/consumers/odr

Other International Users

Delaware law applies, except where your local consumer protection laws provide stronger protections.

11. Changes to Terms

We may update these Terms. Material changes will be communicated via email or in-app notification 30 days before taking effect. Continued use means you accept the updated Terms.
