1. Introduction

Built by Foundry, Inc., formerly known as Playpen Games, Inc. ("Foundry," "we," "us," or "our"), operates the Is This BS mobile application ("App") in collaboration with Professor Dave Explains. 2. Information We Collect

2.1 Information You Provide

• Account details: Name and email (via Sign in with Apple; account creation is optional)
• Claims and arguments: Text, debate turns, diagnostic answers, and free-form lesson or drill responses you submit for analysis or grading
• Images: Photos of claims that you choose from your camera or photo library
• Dictation: Speech transcripts you choose to create with the microphone and your device's speech-recognition service
• Interests: Topics and categories you select during onboarding
• Challenge responses: Your answers to daily challenges
• Support requests: Feedback and questions you send us

2.2 Camera, Photos, and Dictation

Camera, photo-library, microphone, and speech-recognition access is optional and requested only when you choose the corresponding feature. Selected images are sent through our secure backend to the AI service for analysis. The App sends speech to the operating system's speech-recognition service and receives the resulting transcript; Foundry and the App do not retain the raw microphone audio. You can always type or paste text instead.

2.3 Automatically Collected Information

Usage Analytics: We use PostHog to understand how people use the App (screens viewed, features used, session length). Users are identified by their account ID for analytics purposes.Device Information: Device model, operating system, app version, IP address (general location only), language settings.

2.4 AI-Processed Data

When you submit a claim, argument, diagnostic answer, lesson response, drill response, or selected image, the content is sent through our secure backend. We use OpenRouter to route AI inference to a selected model provider and use OpenAI moderation to screen user-authored text. Text claims may be hashed and cached so that identical or similar claims can return a previous analysis without another AI request. We do not store the selected image itself in the claim cache, although the claim extracted from it and the resulting analysis may be stored.AI provider practices: Foundry does not use your submissions to train a third-party model and does not share individual submissions with other users. For OpenRouter inference, our backend requests zero-data-retention routing and denies provider data collection. AI processing remains subject to the applicable provider contracts, configurations, and privacy terms.AI Limitations: AI analysis is for educational purposes only. It may contain errors and is not reviewed by scientists, journalists, or other professionals before being displayed.

3. How We Use Your Information

• Analyze claims and images, run debates and diagnostics, and grade free-form responses using AI
• Deliver daily challenges and educational content
• Track your streaks, XP, and progress
• Send scheduled reminder notifications (you control frequency)
• Sync your data across devices
• Provide customer support
• Improve the App using aggregated, anonymized analytics
• Detect fraud and security issues
• Comply with legal obligations

4. Third-Party Service Providers

We disclose only the information reasonably needed to service providers that operate, secure, analyze, or process purchases for the App. They process information under their agreements with us and their own legal obligations.AI Processing: OpenRouter (routing to selected model providers under zero-data-retention and data-collection-denial settings) and OpenAI moderation (safety screening). 5. International Data Transfers

The App is hosted in the United States. If you access from other regions, your data is transferred to and processed in the US.EU/UK Users: International transfers are handled under the legal mechanisms and safeguards available for the applicable provider and request. Those mechanisms may vary by service and processing location. You can request information about the safeguards used for a particular transfer by contacting privacy@builtbyfoundry.io.

6. Data Retention and Deletion

We retain data only as long as necessary or required by law.While Your Account is Active: Account info, claim history, diagnostic results, debate sessions, graded responses, challenge responses, streaks, XP, and settings may be stored as long as you use the App. Cached claim analyses may be retained to improve performance. Selected source images and raw microphone audio are not stored in the claim cache.After deletion: We remove or de-identify eligible active account records after a verified deletion request. Copies may remain temporarily in backups or where security, fraud prevention, transaction, accounting, or other legal obligations permit or require retention. Analytics, cache, purchase, and support records are kept only as reasonably needed for their stated purposes and legal obligations.

7. Your Privacy Rights

All Users can request access, correction, or deletion of personal data.

EU/UK Users (GDPR)

Additional rights: Data portability, restrict processing, object to processing, withdraw consent, file complaints with your Data Protection Authority.File a complaint: UK (ICO: ico.org.uk), Ireland (dataprotection.ie), or your local EU authority.Legal basis: Contract performance (claim analysis, account management), legitimate interests (analytics, security), consent (notifications), legal obligations.

California Users (CCPA/CPRA)

Additional rights: Know what data we collect and who we share with, delete data, correct inaccuracies, opt-out of data sales (we don't sell data), limit use of sensitive information.You can designate an authorized agent to make requests. We verify identity before fulfilling requests. No discrimination for exercising rights.

How to Exercise Rights

Email privacy@builtbyfoundry.io with your name, email, user ID (Settings → Profile), and specific request.In-app deletion: Settings → Account → Delete AccountWe respond within the time required by applicable law and do not charge except where the law permits a reasonable fee.

8. Children's Privacy

Is This BS is not directed to children under 13. We do not knowingly collect data from children under 13.Parents: If your child under 13 has provided information, contact privacy@builtbyfoundry.io. We will investigate and delete the information when required.Teens (13-17): Review this policy with a parent or guardian.

9. Data Breach Notification

If a security incident affects personal information, we will investigate, contain it, and provide notices to regulators or affected people when and as required by applicable law.Report security concerns: privacy@builtbyfoundry.io

10. Security

We use administrative, technical, and organizational safeguards designed to protect personal information, including access controls and protections offered by our hosting and authentication providers. No system is completely secure.You should: Protect your device passcode and biometric authentication, use a strong Apple account password, enable two-factor authentication.

11. Updates to This Policy

We may update this policy as the App or law changes. The Last Updated date shows when it was revised. If a change materially affects how we use personal information, we will provide notice by a reasonable method where required.
