1. Agreement to Terms

These Terms of Service govern your use of the Do Hard Things mobile application ("App") operated by Built by Foundry, Inc., formerly known as Playpen Games, Inc. ("Foundry"). By using the App, you agree to these Terms and our Privacy Policy. If you don't agree, please uninstall the App.Age Requirement: You must be at least 13 years old to use Do Hard Things. If you're 13-17, review these Terms with a parent or guardian.

2. About Do Hard Things

Do Hard Things is an iOS and Android application from Built by Foundry, Inc. and creator Rich Hernandez (@dohardthings365). It counts pushup reps with on-device camera tracking, uses LiDAR on supported Apple devices, coaches pacing with audio cues, runs structured challenges (the Pyramid, the Metronome, and Time Under Tension), tracks personal records, and shows verified results on a leaderboard when you choose to join.
Not Medical or Professional Fitness Advice: Do Hard Things provides general fitness content and rep counting. It is not medical advice, physical therapy, or personalized coaching, and it is not a substitute for guidance from a physician or qualified professional. Consult a doctor before starting any exercise program, especially if you have a wrist, elbow, shoulder, back, or heart condition, are pregnant, or have any other condition that could be affected by strenuous exercise. Stop immediately if you feel pain, dizziness, or shortness of breath. You are responsible for training within your own limits; pushup challenges are strenuous by design, and you assume the risks of participating.
Rep Counting Accuracy: Camera and LiDAR rep counting runs on your device and is tuned to be conservative and honest, but no automated tracker is perfect. Lighting, clothing, camera placement, and body position affect detection. The App flags uncertain reps for your review rather than silently deciding. Counts, ranks, and verification states are provided for training and community competition, not as certified measurements.
Creator Content: Rich Hernandez's name, likeness, voice cues, benchmarks, and training method appear in the App under license. Rich's benchmarks are real reference results, but your results depend on your own training. Nothing in the App implies Rich supervises your individual training.

3. Account Registration

Some features require an account via Sign in with Apple or Google. You agree to provide accurate information, keep credentials secure, and notify us of unauthorized access. You're responsible for all account activity.

4. Premium Subscriptions and Billing

Do Hard Things is free to download. The launch release opens the complete training path, advanced challenges, produced proof exports, monthly promise recovery, and private crews without a purchase or subscription. If paid features are introduced later, the App will show the price and renewal terms before any purchase.

5. User Content

Your content: You keep ownership of your training history, challenge results, calibration data, proof files, and other content you create in the App. Your full training data stays on your device. Entering a handle opts eligible ranked results into weekly boards. You grant Built by Foundry a worldwide, non-exclusive, royalty-free license to store, transmit, and display those submitted results solely to operate the board and App. Private crew data is visible only to invited crew members.Leaderboard conduct: Ranked results must be your own reps, produced through the App's counting flows. Manipulating detection, submitting falsified results, using an abusive or deceptive handle, impersonating others, or attempting to game verification tiers may result in removal of results or suspension of leaderboard access. Athletes may hide an identity immediately and submit a fixed-reason safety report. Built by Foundry may review reports, suppress reported identities, remove results, and preserve enforcement records. Honest counts are the product.Deletion: Open You > Account & Data > Delete profile and training data to remove your private crew profile and weekly board entries, then erase local runs, records, settings, and app-owned proof files. Safety reports about public board activity may remain as an abuse-prevention and enforcement record. Copies you saved to Photos or shared with other people remain under your control.

6. End User License Agreement

This section is Do Hard Things' End User License Agreement (EULA) and supplements these Terms of Service. On Apple devices, the Apple Licensed Application End User License Agreement at https://www.apple.com/legal/internet-services/itunes/dev/stdeula/ also applies except where these Terms modify it.License: Subject to your compliance with these Terms, Built by Foundry grants you a limited, non-exclusive, non-transferable, revocable license to install and use Do Hard Things on a mobile device that you own or control, solely for your personal, non-commercial use.Restrictions: You will not (a) copy, modify, or create derivative works of the App except as permitted by law, (b) reverse engineer, decompile, or disassemble the App except to the extent such restriction is prohibited by law, (c) rent, lease, lend, sell, sublicense, or otherwise transfer the App, (d) remove or alter any proprietary notices, (e) use the App to build a competing product, (f) extract or redistribute Rich Hernandez's voice, likeness, or training content, or (g) use the App in violation of applicable law.Reservation: Built by Foundry, Rich Hernandez, and their licensors retain all right, title, and interest in and to the App and its content, including all intellectual property rights. No rights are granted except as expressly stated.Termination: This license terminates automatically if you materially breach these Terms. On termination, you must stop using and delete the App. Sections that by their nature should survive (including intellectual property, disclaimers, limitation of liability, and dispute resolution) will survive termination.Third-party beneficiary: Apple and its subsidiaries are third-party beneficiaries of these Terms for Apple-device licenses and may enforce those terms against you.Export and sanctions: You represent that you are not located in a country subject to a U.S. Government embargo or on any U.S. Government restricted-party list.

7. Prohibited Conduct

Don't: reverse engineer the App, attempt unauthorized access, use bots or scrapers, share account credentials, distribute abusive content, violate laws, interfere with the App's operation, or commercially exploit App content.We may suspend or terminate accounts that violate these Terms.

8. Limitation of Liability

The App is provided "as is" without warranties. To the fullest extent permitted by law:We're NOT liable for indirect, incidental, or consequential damages (including lost data)
Our total liability is capped at the greater of what you paid us in the last 12 months or $100 USD
Exceptions: This doesn't limit liability for death/injury from gross negligence, fraud, or liability we can't exclude by law. EU/UK/California consumer rights are not affected.If you experience harm related to App content, report it to hello@builtbyfoundry.io. We'll investigate and take appropriate action.

9. Dispute Resolution

Try to Resolve First: Contact hello@builtbyfoundry.io before filing legal claims.

US Residents

Arbitration: Disputes resolved through binding individual arbitration (AAA Consumer Arbitration Rules), except small claims court. Location: Delaware or your county (your choice). We pay AAA fees for claims under $10,000. No class actions.Opt-Out: Email hello@builtbyfoundry.io within 30 days of first use with "Arbitration Opt-Out" in the subject line.

California Residents

California law applies. You may choose JAMS instead of AAA. If class waiver is unenforceable, arbitration clause is void.

EU/UK Residents

No Forced Arbitration: This arbitration clause does NOT apply. You retain rights under EU consumer laws, including bringing disputes in your local courts. EU Online Dispute Resolution: ec.europa.eu/consumers/odr

Other International Users

Delaware law applies, except where your local consumer protection laws provide stronger protections.

10. Changes to Terms

We may update these Terms. Material changes will be communicated via email or in-app notification 30 days before taking effect. Continued use means you accept the updated Terms.
